Privacy Notice

ABAKU ("we"), reachable at hola@abaku.mx, is responsible for the personal data collected through abaku.mx, our school-management platform, and our customer-service channels. This notice explains what we collect, why, and the rights you hold, in accordance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and, where applicable, other regulations.

1. Data we collect

Identification and contact data: name, email address, phone/WhatsApp number, institution and role, when you provide them in forms or conversations.

Conversation content: messages you exchange with us on the website chat, WhatsApp, email and voice calls — including automatic transcripts of voice calls.

Technical data: IP address, approximate location derived from it, browser and device type, pages visited, and identifiers stored in your browser (see Cookies).

Billing data of institutional customers, when contracting our services.

2. Service provided by AI assistants

Our sales and support channels are operated primarily by ARTIFICIAL-INTELLIGENCE ASSISTANTS, always identified as such ("AI" label). By chatting or calling, you interact with an automated system supervised by humans.

Conversations are stored and may be reviewed by our team to supervise quality, train and adjust the assistants, and resolve your case.

The assistants keep a "memory" of relevant facts you share (e.g., your name, preferences, pending matters) to give you continuity across channels and sessions.

Voice calls are processed in real time by an AI provider and transcribed; the transcript is stored with your conversation history. Calls are not answered by default: they happen only when you accept or schedule one.

You may request human attention at any time.

3. Purposes

Primary: answering questions, providing support and follow-up, quoting and selling our services, scheduling calls or demos, and keeping conversation continuity.

Secondary (you may object): service-quality analysis, product improvement and aggregated statistics.

4. Processors and transfers

AI providers (e.g., OpenAI or equivalent): receive conversation content to generate the assistant's responses and call audio to converse and transcribe. They act as processors under contract; we do not authorize them to use your data for their own purposes.

Meta Platforms (WhatsApp Business API): message delivery when you write to us on WhatsApp, subject to WhatsApp's own terms.

Hosting and e-mail infrastructure providers, for storage and delivery.

We do not sell or rent your personal data. No transfers requiring consent are made without obtaining it.

5. Student data

When educational institutions use the ABAKU platform, data of their students and staff is processed on behalf and under the instructions of the institution, which remains responsible for it. This notice covers data collected directly by ABAKU.

6. Cookies and local storage

We use our own cookies/local storage to: remember your language and theme, keep your chat-conversation token so the assistant recognizes you when you return, and measure visits anonymously. You can clear them in your browser at any time; the chat will simply forget the local session.

7. Security and retention

Sensitive credentials are stored encrypted; access to conversations is restricted to authorized personnel. Data is kept while needed for the purposes above or while a business relationship exists, and afterwards only as required by law.

8. Your rights (ARCO)

You may access, rectify, cancel or object (ARCO), limit use, or revoke consent by writing to hola@abaku.mx with your name, the right you wish to exercise and the channel where you interacted with us. We will respond within 20 business days.

If you believe your rights have been violated, you may contact the INAI (www.inai.org.mx).

9. Changes to this notice

We may update this notice; the current version will always be available at abaku.mx/aviso-de-privacidad with its update date.
